Terms of sale

1. Purpose
These terms govern the online sale of the "Hybrid Or" (signal indicator) and "Melym Risk" (position size calculator) programs for the MetaTrader 5 platform (together or separately, the "Product"), sold by Melym, a French micro-entreprise (the "Seller").
2. Product
The Product is a compiled program for MetaTrader 5 (Expert Advisor) that displays technical analysis signals (Hybrid Or) or calculates a position size (Melym Risk), and that opens no positions, together with a user license linked to the MetaTrader 5 account number specified by the buyer when ordering. The source code is not provided. Using the Product requires the MetaTrader 5 platform and a broker account, which are not provided by the Seller, as well as an Internet connection for the periodic license check. The Product is a generic technical analysis tool: it constitutes neither investment advice nor a personal recommendation, and it does not guarantee any financial result.
3. Price
Three plans are offered: (1) Hybrid Or monthly: a subscription of €19.99 including VAT per month, charged on the day of the order and then automatically every month on the same date; (2) Hybrid Or yearly: a subscription of €199.99 including VAT per year, charged on the day of the order and then on each anniversary date; (3) Melym Risk standalone: a subscription of €9.99 including VAT per month, charged on the day of the order and then every month. The Hybrid Or plans include Melym Risk. Each subscription maintains access to the relevant Product, in its latest version, and to support. The applicable prices are those displayed at the time of the order. Payments are processed by Stripe; the Seller never has access to your card details.
4. Delivery
As soon as payment is confirmed, the order confirmation page gives access to the Product download and the license key. The buyer is responsible for the accuracy of the MetaTrader 5 account number provided; in case of error or a change of account, the buyer simply needs to contact support.
5. Right of withdrawal
In accordance with Article L221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised for the supply of digital content not provided on a tangible medium, where performance has begun with the consumer's prior express consent and express waiver of the right of withdrawal. By confirming the order, the buyer requests immediate access to the Product and acknowledges losing the right of withdrawal once access has been provided.
6. Term, renewal and cancellation of the subscription
The subscription has no minimum term and renews automatically at the end of each period (one month or one year depending on the plan). For the yearly plan, a reminder is sent by email before each renewal. The buyer may cancel at any time, at no cost and without giving a reason, from the customer portal (the "Manage my subscription / cancel" link on the confirmation page) or by email. Cancellation takes effect at the end of the current period (month or year); no pro-rata refund is made. At the end of the paid period, the license is no longer valid and the Product stops working.
7. License
The license is personal, non-exclusive and non-transferable, and limited to the specified MetaTrader 5 account. Reselling, sharing, decompiling, bypassing the license check or attempting to reproduce the Product is prohibited.
8. Liability and risks
Trading CFDs, currencies and commodities involves a high risk of losing capital. The results shown on the website come from simulations on historical data and are not indicative of future results. The buyer remains solely responsible for their trading decisions and their consequences. The Seller cannot be held liable for financial losses related to the use of the Product.
9. Updates and support
New versions of the Product are available for download from the order confirmation page. Email support (contact) is provided as long as the subscription is active.

11. Disputes
In the event of a dispute, the buyer is invited to contact the Seller by email first in order to seek an amicable solution. These terms are governed by French law.
